Terms of Use
1. Agreement
By downloading, installing, accessing, or using a RicaMedia application or website, you agree to these Terms of Use. If you do not agree, do not use the applicable service.
"RicaMedia", "we", "us", and "our" refer to RicaMedia and the applicable operator of the relevant application or service.
2. License and EULA
Subject to these Terms, RicaMedia grants you a limited, non-exclusive, non-transferable, revocable license to install and use the applicable application on compatible devices that you own or control for your personal, lawful use.
The application is licensed, not sold. Your license does not transfer ownership of the application or any intellectual-property rights to you.
3. Intellectual Property
The application, website, software, source code, designs, graphics, trademarks, logos, text, and other materials provided by RicaMedia are owned by or licensed to RicaMedia and are protected by applicable intellectual-property laws.
Except for the limited license expressly granted in these Terms, no intellectual-property rights are transferred to you.
4. Acceptable Use
You agree not to:
- use the service for unlawful, fraudulent, abusive, or harmful purposes;
- interfere with or disrupt application infrastructure or security;
- attempt unauthorized access to accounts, systems, or data;
- reverse engineer, decompile, disassemble, or attempt to derive source code, except to the extent such restriction is prohibited by applicable law;
- circumvent technical protections, licensing mechanisms, or access controls;
- copy, redistribute, sublicense, rent, lease, or resell the application except as expressly permitted;
- use the service to infringe another person's rights.
5. Accounts
If an application supports accounts, you are responsible for providing accurate information and maintaining the confidentiality of credentials associated with your account.
You are responsible for activity occurring through your account unless caused by circumstances outside your reasonable control.
6. In-App Purchases and Subscriptions
Some RicaMedia applications may offer paid features, consumable purchases, non-consumable purchases, or subscriptions through Apple's App Store or Google Play.
Purchases are processed by the applicable app store and are subject to that platform's payment terms.
Subscription pricing, billing periods, introductory offers, and renewal terms are presented through the applicable store purchase interface.
Where a subscription automatically renews, it will renew according to the applicable platform's rules unless canceled through the user's platform subscription controls before the applicable renewal deadline.
RicaMedia may use a service such as RevenueCat to manage subscription entitlements where enabled.
7. Refunds and Billing Support
Purchases made through Apple App Store or Google Play are generally subject to the refund and billing procedures of the applicable platform.
Refund requests should therefore be submitted through the platform that processed the transaction, except where the applicable platform or law directs otherwise.
RicaMedia may assist with product-related questions, but cannot guarantee that a platform will approve a refund.
8. Apple and Google Platform Terms
If you obtained a RicaMedia application through Apple's App Store, Apple's applicable terms and usage rules also apply.
If you obtained an application through Google Play, Google's applicable terms and usage rules also apply.
Apple Inc. and Google LLC, as applicable, and their subsidiaries are intended third-party beneficiaries of these Terms solely with respect to the applicable application and may enforce provisions relating to their rights as permitted by the applicable platform agreement.
9. Device and Hardware Compatibility
Application functionality may depend on compatible hardware, operating system versions, network connectivity, device settings, and permissions.
RicaMedia does not guarantee that every application will function on every device, operating-system version, carrier, or network configuration.
Features using cameras, microphones, location services, biometrics, Bluetooth, notifications, or other hardware may require compatible device capabilities and operating-system permissions.
10. Third-Party Services
Applications may integrate third-party services, APIs, SDKs, payment providers, analytics systems, cloud infrastructure, or external content.
Their availability and operation may be subject to the provider's own terms and policies.
RicaMedia is not responsible for independent changes, outages, or policies of third-party services that are outside our reasonable control.
11. Availability and Changes
We may modify, suspend, discontinue, or update an application or feature when reasonably necessary for maintenance, security, legal compliance, technical changes, or product development.
We do not guarantee that a service will always be available, uninterrupted, error-free, or compatible with future operating-system releases.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the services and applications are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded under the laws applicable to you.
13. Limitation of Liability
To the maximum extent permitted by law, RicaMedia and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the service.
To the maximum extent permitted by law, RicaMedia's aggregate liability for claims arising from the applicable service will be limited to the amount you paid to RicaMedia for that service during the twelve months preceding the event giving rise to the claim, or the minimum amount required by applicable law if greater.
14. Indemnification
To the extent permitted by applicable law, you agree to defend and hold harmless RicaMedia from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the service, violation of these Terms, or infringement of another person's rights.
15. Termination
Your license to use an application terminates automatically if you materially violate these Terms.
Upon termination, you must stop using the application and delete copies under your control where reasonably applicable.
16. Governing Law
These Terms are subject to the mandatory consumer-protection and other applicable laws governing your relationship with RicaMedia.
Nothing in these Terms is intended to deprive you of rights that cannot legally be waived or limited.
17. Changes to These Terms
We may update these Terms from time to time.
The updated version will be posted at this URL with a revised effective date.
Continued use of the applicable service after an update constitutes acceptance to the extent permitted by applicable law.
